Terms of Service | AI Resource Generator

These Terms of Service ("Terms") govern your use of the AI Resource Generator platform ("Platform", "Service") operated by AI Resource Generator ("we", "us", "our"). By creating an account or using the Platform, you agree to be bound by these Terms.

1. Service Description

AI Resource Generator is a platform that uses artificial intelligence to generate training resource documents for Registered Training Organisations (RTOs) in Australia. The Service generates documents including assessment tasks, learner guides, mapping documents, presentations, and online learning activities based on unit competency data sourced from training.gov.au.

Important: All generated documents are produced using artificial intelligence and must be reviewed by your compliance and academic team before use in training and assessment delivery. We do not guarantee that generated content meets specific regulatory or accreditation requirements.

2. Account Registration

You must provide accurate and complete information when creating an account
You are responsible for maintaining the confidentiality of your account credentials
You must be at least 18 years of age to use the Platform
One account per individual; one organisation per registration (unless agreed otherwise)
You are responsible for all activity that occurs under your account
You must notify us immediately of any unauthorised use of your account

3. Credits and Payment

3.1 Credit System

The Platform operates on a credit-based system. Each document generation consumes credits.
New accounts receive a limited number of free trial credits
Free trial accounts have access to Step 1 documents only (AT1, AT2, PowerPoint, Online Learning)
Full package access (Learner Guide and Mapping Document) requires a paid credit purchase
Credit costs per generation type are displayed in the Platform and may be updated from time to time
Purchased credits do not expire

3.2 Payments

All prices are in Australian Dollars (AUD) and include GST where applicable
Payments are processed securely through Stripe
We do not store your credit card information
You agree to pay all fees associated with your credit purchases

3.3 Refund Policy

We offer refunds in accordance with Australian Consumer Law:

Unused credits: Full refund within 14 days of purchase if no credits have been used from that purchase
Service failure: If the Platform fails to generate documents due to a technical error on our end, we will either restore the consumed credits or provide a refund
Quality issues: If generated documents are substantially deficient or unusable, contact us within 7 days for a credit restoration or refund
No refund: Credits that have been successfully used to generate documents are non-refundable, as the service has been delivered

To request a refund, email support@airesourcegenerator.com.au with your account details and reason for the request.

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.

4. Acceptable Use

You agree not to:

Use the Platform for any unlawful purpose
Misrepresent AI-generated content as having been created by a human without any AI involvement
Attempt to reverse-engineer, decompile, or extract the underlying AI models or prompts
Use automated scripts or bots to access the Platform (other than through our API)
Share your account credentials with unauthorised third parties
Upload malicious files or attempt to compromise Platform security
Resell generated content as a competing document generation service
Use the Platform to generate content for purposes unrelated to vocational education and training

5. Intellectual Property

5.1 Your Content

You retain ownership of your organisation details, branding assets, and any content you upload
Generated documents are yours. Once generated, you own the output documents and may use, modify, and distribute them within your organisation
You grant us a limited licence to use your organisation details solely for the purpose of generating branded documents

5.2 Our Platform: Intellectual Property Protection

Copyright Notice: The AI Resource Generator platform, including but not limited to its source code, algorithms, AI prompt engineering, document templates, user interface design, branding, architecture, business logic, and all associated documentation, is the exclusive intellectual property of AI Resource Generator (ABN 57 467 878 621) and is protected under the Copyright Act 1968 (Cth), international copyright treaties, and applicable intellectual property laws.

No Reproduction: You may not copy, reproduce, replicate, reverse-engineer, decompile, disassemble, or create derivative works of any part of the Platform, its functionality, design, or underlying technology
No Competing Use: You may not use knowledge gained from using the Platform to build, develop, or assist in developing any competing product, service, or platform that replicates or substantially imitates the functionality, features, or business model of AI Resource Generator
No Distribution: You may not redistribute, sublicence, sell, lease, or otherwise transfer access to the Platform or any of its components to any third party
Trade Secrets: The AI prompts, document generation methodology, content structuring algorithms, and system architecture constitute trade secrets. Any unauthorised disclosure or use of these trade secrets will result in immediate legal action
Confidentiality: All non-public aspects of the Platform, including its internal functionality, API structure, and generation processes, are confidential. By using the Platform, you agree to maintain this confidentiality
Unit competency data is sourced from training.gov.au (Australian Government) and is subject to their terms of use

Enforcement: We actively monitor for intellectual property infringement. Any breach of this section entitles us to seek immediate injunctive relief, damages (including consequential and punitive damages), legal costs, and any other remedies available under Australian law. You agree that monetary damages alone would be an insufficient remedy for any breach of this section.

6. AI-Generated Content Disclaimer

Please read carefully:

All documents generated by this Platform are produced using artificial intelligence
Generated content may contain errors, inaccuracies, or omissions
Documents must be reviewed, validated, and approved by qualified professionals within your organisation before use
We do not guarantee that generated content meets specific accreditation, regulatory, or quality framework requirements
Your organisation is solely responsible for ensuring that training and assessment materials comply with applicable standards and regulations
The Platform is a productivity tool that generates a starting point, not a replacement for professional curriculum development and compliance review

7. Service Availability

We aim to provide 99.9% uptime but do not guarantee uninterrupted service
We may perform maintenance with reasonable notice where possible
Document generation depends on third-party AI services and may occasionally experience delays or temporary unavailability
We are not liable for losses arising from service interruptions beyond our reasonable control

8. Limitation of Liability

To the maximum extent permitted by law:

Our total liability for any claim arising from your use of the Platform is limited to the amount you paid us in the 12 months preceding the claim
We are not liable for indirect, incidental, special, consequential, or punitive damages
We are not liable for any losses arising from your reliance on AI-generated content without independent verification
We are not liable for any regulatory action taken against your organisation relating to materials generated by the Platform

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

Your use of generated documents in training and assessment delivery
Your breach of these Terms
Your violation of any applicable law or regulation
Any third-party claims arising from your use of the Platform

10. Account Suspension and Termination

We may suspend or terminate your account if you breach these Terms
You may close your account at any time by contacting support
Upon termination, unused credits may be refunded at our discretion (see Refund Policy)
We will retain data as required by law and our Privacy Policy

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through a notice on the Platform at least 14 days before the changes take effect. Continued use of the Platform after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Australia and the State of Queensland. Any disputes will be subject to the non-exclusive jurisdiction of the courts of Queensland, Australia.
